● Breakaway Club reserves the sole right to determine, fix and modify the prices of the services provided by them, subject to the requirement of the customers and/or change in the price of ancillary products/ services playing a role in the services provided by Breakaway Club, without notice at any time.

● Breakaway Club does not promote alcohol, immoral, or illegal activities. If any such activities are found on the tours, the respective individual(s) will be held responsible and accountable. 

● Breakaway Club reserves the sole right to provide, continue or discontinue theservice, or any part thereof, subject to change without notice at any time.

● We reserve the right to accept or reject service to anyone for any reason at any time. This site is designed, updated and maintained by Breakaway Club or itslicensors. A breach or violation of any of these Terms and Conditions willresult in an immediate termination of your Services with Breakaway Club.

● We reserve the right to immediately cancel the booking of an individual if he/she causes any kind of misbehaviour, misconduct, violet or criminal activity, and/or whose incurable inconvenience affects the tour plan of the group. 

GENERAL CONDITIONS

1. ACCEPTANCE OF TERMS: 

These Terms and Conditions constitute an “offer” and the “acceptance” isexpressly limited to these Terms and Conditions. All services and information displayed on the Website constitute an “invitation to offer.”

Availing any services from our website, constitutes your “offer” which shall be subject to confirmation from the Breakaway Club and these Terms and Conditions. We reserve the right to “accept” or “reject” your offer in part or in full. Once the confirmation email is received from Breakaway Club, the offer shall be deemed to be “accepted.” No act or omission of Breakaway Club priorto the actual confirmation of the services availed will constitute acceptance of your offer.

2. BOOKINGS AND PAYMENTS:

• Prices are subject to change until full payment is received.

• Payment must be made through approved payment methods listed on the website.

• You agree to provide accurate billing information.

• In case of payments scheduled in instalments, if there is a delay in complying with the first instalment, the same may result in price fluctuation for the following instalments. 

• Unreasonable delay and/or default in payment of a instalment will result in cancellation of the individual. 

Without prejudice to the above, we reserve the right to cancel bookings due to pricing errors, availability issues, or suspected fraudulent activity.

3. CANCELLATION AND REFUND: 

• Cancellation and refund policies may vary depending on the trip, partner, or service provider.

• Specific cancellation terms will be provided at the time of booking.

• Refund timelines may vary depending on payment processors and third-party providers.

• Certain bookings may be non-refundable.

• Any misconduct, misbehaviour, violent or illegal activity will result in immediate cancellation of the responsible individual, along with our right to claim monetary compensation from the individual. 

• Any delay caused to the group in respect of Visa rejection and/or refusal of entry in a country and/or delay in taking a connecting flight will result in immediate cancellation of the responsible individual.

4. TRAVEL RISKS AND RESPONSIBILITY:

Travel involves inherent risks. By booking with us, you acknowledge:

o We act as an intermediary between you and third-party travel providers (travel, hotels, tour operators).

o We are not responsible for acts, errors, delays, cancellations, or negligence of third-party providers.

o You are responsible for ensuring you have valid passports, visas, travel insurance, and required documentation.

5. CHANGES/ MODIFICATIONS TO SERVICE PLAN/ ITENERARIES:

We reserve the right to:

• Modify itineraries due to weather, safety concerns, or operational requirements.

• Substitute accommodations or services of similar standard when necessary.

6. USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS:

If the delay or failure of performance of the obligations of Breakaway Club is in any manner affected due to the occurrence and continuance of such Force Majeure Event then the period of performance of the obligations of Breakaway Club towards you shall automatically stand extended for such period affected by such Force Majeure Event.

You agree to defend, indemnify and hold harmless Breakaway Club and our founder, proprietors, partners, licensors, contractors, suppliers, dealers, agents, employees, service providers, and subsidiary companies from and against anyand all claims, liabilities, damages, losses, costs and expenses, including Attorney’s fees, caused by claims arising out of your actions or inactions resulting from your use of the services of Breakaway Club, breach of these Terms and Conditions, violation of any law or rights of the third party and/or use of data gathering and extraction tools.

A Sole Arbitrator shall be appointed by mutual consent of the parties and the language of the arbitration shall be English.
